After decades teaching constitutional law in the United States, Dr. Charles Lugosi is back practicing law in Canada, and has taken Mary Wagner as his client. Her case highlights some foundational issues in Canadian constitutional law. Kari Simpson and Ron Gray interview this distinguished legal scholar and pro-life activist (his doctoral dissertation posited that slavery and abortion are almost identical human rights violations) to learn how the Wagner case represents all Canadians’ free speech rights.

Ron Gray weighs in on the ramifications of dynastic politics in Canada. To do so, he needs to look no farther than the United States, which has a long history of such a political phenomenon. Is Canada finally "catching up" to the U.S., or is it a major step backwards?

Legal Fact: Canadian Women Don’t Have a ‘Right’ to Abortion

Muddying the waters with selective quotes in an attempt to support an untenable position is not conducive to fruitful discourse.

Edmonton, Alberta – January 28, 2013 marks the twenty-fifth anniversary of R. v. Morgentaler. While many Canadians grieve the loss of a full quarter of their generation, others are celebrating the day with exuberance, calling all pro-choice Canadians to protect the rights they’ve earned.

“I cannot believe some of the things written and said in the media today. It is a complete misconception that women have a ‘right’ to abortion and it’s certainly not what the Supreme Court said twenty-five years ago,” said WeNeedaLAW.ca campaign director, Mike Schouten.

“While abortion defenders enjoy referencing Justice Bertha Wilson – the first woman appointed to the Canada’s Supreme Court – they all too often choose selective quotes that completely misrepresent what Justice Wilson said,” continued Schouten.

Here follows an excerpt from Justice Wilson’s concurring opinion. It should be noted that Justice Wilson’s opinion was not shared with the other six judges – she wrote alone – and the other judges were all more “conservative” in their three written opinions:

“As Professor Sumner points out, both traditional approaches to abortion, the so-called “liberal” and “conservative” approaches, fail to take account of the essentially developmental nature of the gestation process. A developmental view of the foetus, on the other hand, supports a permissive approach to abortion in the early stages of pregnancy and a restrictive approach in the later stages. In the early stages the woman’s autonomy would be absolute; her decision, reached in consultation with her physician, not to carry the foetus to term would be conclusive. The state would have no business inquiring into her reasons. Her reasons for having an abortion would, however, be the proper subject of inquiry at the later stages of her pregnancy when the state’s compelling interest in the protection of the foetus would justify it in prescribing conditions. The precise point in the development of the foetus at which the state’s interest in its protection becomes “compelling” I leave to the informed judgment of the legislature which is in a position to receive guidance on the subject from all the relevant disciplines. It seems to me, however, that it might fall somewhere in the second trimester. Indeed, according to Professor Sumner (p. 159), a differential abortion policy with a time limit in the second trimester is already in operation in the United States, Great Britain, France, Italy, Sweden, the Soviet Union, China, India, Japan and most of the countries of Eastern Europe although the time limits vary in these countries from the beginning to the end of the second trimester (cf. Stephen L. Isaacs, “Reproductive Rights 1983: An International Survey” (1982-83), 14 Columbia Human Rights Law Rev. 311, with respect to France and Italy). -R. v. Morgentaler 1988 (Emphasis added)

“Justice Wilson was abundantly clear – abortion should not be legal throughout all the stages of foetal development, and it is in the hands of the Legislature, not the courts, to decide at which stage it should be restriced,” continued Schouten.

“I think it is great that after twenty-five years we are still having this debate. However, we should be properly informed of the legal facts. Muddying the waters with selective quotes in an attempt to support an untenable position is not conducive to fruitful discourse,” concluded Schouten.

Peggy Clores’ open letter to the World Health Organization

LIFESITENEWS.COM

This is an appeal to conscience, human decency, and humanity. Please confront the responsibility to read this through. I would appreciate a response explaining the World Health Organization’s counsel in the following matter.

I am apprised of your recent manual on the “best way to kill unborn babies”.

This is not the organization’s categorization yet terminology does not change objective reality.

Like Hitler, you sanitize language to cover up crimes against humanity. With the advancements made in ultrasound technology in this last 20 year period, the question of whether or not the “fetus” is a human being from the very first moment of conception has been radically resolved for persons of right functioning conscience. Yet, like Hitler, you hide the evidence from the world and from your heart.

The Third Reich, too, continually came up with new and more efficient ways to get the job done.

Apart from the radical issue of conscience and objective morality, it is incomprehensible, with all of the evidence of the demolition on every level to a woman’s health caused by abortion physically, mentally, and psychologically, that you would recklessly continue to recommend abortion as a health option in entire disregard for a woman’s health.

When is the madness going to end.

A “health” organization has a grave responsibility to offer only the best of health standards and counsel. Women deserve better. A “health” organization cannot justify crimes against humanity. This is beyond appalling and the extermination of human life has superceded Hitler’s crimes against humanity to incomprehensible proportions. 1.5 million lives ended annually each year in the United States alone since 1973.

WHO are you? What are you? What have you become?

In defense of all women and in memory of my grandparents exterminated in Auschwitz Concentration Camp, I urge you to live up to your responsibility to humanity and to your name.

I urge your hearts and minds to confront the atrocities and end the deadening and rationalizations of your consciences.

I urge you to confront the reality of your “health” counsel.

Nothing, absolutely nothing can justify your recommendations or your standards.

Weigh Station: Barack Obama is Not America’s First Black President

RoadKill Radio News exposes the truth behind urban legends.

Come back each week for a new weigh-in, and feel free to suggest items for us to weigh.

(HEAVY = True, Average = Partly True, and Nil = False.)

+-+-+-+-+-+-+-+-+-+-+-+-+

On the Scale: Barack Obama is Not America’s First Black President

US President Barack Obama is the son of a man born in Kenya, and is generally accepted as being America’s first Black President. Reports have come out that several earlier US President were also part Black.

Veracity Weight: Average. Barack Obama, the United States’ 44th President, is 50% “Black” by virtue of his father being born in Kenya. Some scholars define “Black” as anyone descending from American Negro slaves, and would refer to President Obama as an Africa-American instead.

Because of the archaic “one drop” rule – that is, if a person has at least one drop of Negro blood by way of a distant relative – it has been claimed (although entirely unsubstantiated) that former US Presidents Thomas Jefferson, Andrew Jackson, Abraham Lincoln, Warren Harding, Calvin Coolidge, and Dwight Eisenhower were Black. In the end, no US President yet has been entirely “Black” or “African-American”, although President Obama has come closest as half-African-American.

Ben Shapiro, editor-at-large at Breitbart.com, puts the sneering ratings whore Piers Morgan in his place regarding Morgan’s skewed argument against assault weapons, which are used – by criminals – in only a tiny fraction of gun crimes in the United States. Flying in the face of statistics, common sense, and American culture, British citizen Morgan insists that taking guns away from law abiding citizens will prevent criminals from using guns, and is appalled by Shapiro’s explanation of the Second Amendment, which was designed by America’s founding fathers in part to deter tyrannical government and to repel invasion – both sentiments originally directed against Morgan’s home, Great Britain.

Battle of the Amendments

RoadKill Radio’s “Letter of the Week” this week is actually a petition – three, in fact. All have to do with CNN Brit tabloid talker Piers Morgan’s stance in favour of banning assault weapons in the United States.

Banning guns is against the US Constitution’s Second Amendment and is a wildly unpopular notion among Americans. Freedom of speech is what the US Constitution’s First Amendment is all about, however, and is a wildly popular notion among Americans. Morgan – even though he is not an American – nevertheless has the First Amendment right to voice his opposition to the Second Amendment.

God bless America!

Morgan’s detractors have their First Amendment rights, too, which has resulted in a series of petitions on the White House’s official petition website.

At the time of this posting, 103,744 people have petitioned the White House to deport Morgan, while 8,822 have petitioned to keep Morgan in the US. Only 6,981 people have supported Morgan’s anti-gun stance by petitioning the White House to ban assault rifles.

Since the White House promises to respond to every petition that reaches 25,000 signatures within a month, it looks like President Obama will be weighing in on this issue in the near future.

FACE TO FACE: Should peacekeeping Canada be shopping for bomber jets?

In a perfect world, the Canadian Armed Forces would not exist, guns would magically be transformed into long-stemmed roses and fighter planes would become fluffy white doves.

But because we are grounded in reality on this side of the page, we recognize that utopia will never be achieved and that a sovereign nation needs an army, an air force and, if it’s a coastal nation, a navy.

Of course, my colleague over yonder isn’t really suggesting Canada should rid itself of its armed forces. He’s merely saying that our air force should be burdened with obsolete equipment, specifically its outdated fighter planes.

He justifies this position on the grounds be believes Canada should concentrate its armed forces on peacekeeping missions. And anyway, spending billions of dollars on the Joint Strike Fighter, also known as the F-35, makes Canada too much like the United States (the Great Satan).

There are multiple problems with his line of thinking. For starters, it’s abundantly clear there’s precious little peacekeeping to do anymore in this topsy-turvy world. On the other hand, as the recent deployment of NATO air power against Muammar Qaddafi ’s forces in Libya has shown, there’s plenty of important peace-making to be done.

You can keep the peace with well-trained, lightly armed, blue-helmeted peacekeepers. But you need real armed forces to make the peace.

It’s also important to note that many of our allies — including Britain, Australia, Denmark, Italy, the Netherlands, Turkey and Norway — will be flying the F-35s. Does my colleague really want to see Canada asking Turkey or Holland for air cover the next time we have to send our troops into a danger zone?

Or maybe the F-35 opponents would prefer that Canada always assume the morally ambiguous, perpetually fence-sitting, pseudo-pacifist “honest broker” position that it adopted in the last half of the 20th century.

But just as you don’t make bargains with the devil, no freedom-loving, democratic country should put itself in a position of constant appeasement and apology. When you encounter an alleged genocidal murderer like Ratko Mladic, you arrest him and put him on trial. You don’t sit down over a cup of coffee and attempt to work out a compromise between him and Lady Justice.

FACE TO FACE: Is ‘getting tough on crime’ a useful approach for our country?

My colleague on the other side of the page has developed the habit of bashing, blaming or otherwise bandying about the name of the United States as a way of adding some gravity to his arguments.

He’s aware of his overuse of the references but will undoubtedly have had to wage an epic battle with his inner Maude Barlow to dissuade himself from dragging the U.S. into today’s debate about the Conservative party’s law-and-order agenda, which leftists throughout our country regularly denounce as being “American-style.” Here’s hoping he has been able to bring something fresh to the Face to Face table…

Several new reasons to yank your kids

or

What the &%@# is going on in the classroom?!?

Recent news reports from Sweden may be harbingers of what to expect in North American schools very soon. A Swedish citizen filed a complaint that the new Sex-Ed film Sex on the Map is child pornography: the animated film depicts a high school math class in which a teacher starts the kids talking about sex; it then shows scenes of teens have sex—in many and perverse permutations.

You can read the full report from The Local (“Swedish News in English”) at:
http://theblogprof.blogspot.com/2011/01/public-ed-swedish-sex-ed-film-reported.html

The story also includes a report that PETA (People for the Ethical Treatment of Animals) is sponsoring an MTV series that is really “child pornography” (i.e., child abuse by sexualizing children).

Nudity and oral sex in a Grade Two classroom—with the teacher present!

The American Internet news site OneNewsNow (January 22, 2011) says a male Grade 2 teacher has been suspended after students at Markham Elementary School in Oakland (across the Bay from San Francisco) reported that classmates stripped off their clothes and engaged in oral sex during class. The full report is at:
http://www.onenewsnow.com/Education/Default.aspx?id=1279310

Also coming soon to tax-funded indoctrination centres (AKA the ‘public school system’) near you:

Compulsory ‘Gender-Bender Days’

Also from the United States comes a report that more and more public schools, to implement promote acceptance of “diversity”, are holding “Gender-Bender Days” during which students are required to cross-dress and pretend they are trans-sexuals/trans-gender or otherwise sexually confused. Ironically, one self-described ‘gay’ student was arrested by local police because she resisted the principal’s edict!

Here’s the website for the “Gender-Bender Days” report (with truly repulsive videos):
http://www.whatswrongwiththeworld.net/2011/01/gender_madness.html

What makes this story important for Canadians is that Barbara Hall (Chief Commissioner of the Ontario Human Rights Commission), and James Chamberlain (Assistant Director, BC Teachers’ Federation Social Issues Division), are working like demented beavers to impose a similar brainwashing agenda on students in Canadian schools. Barbara Hall has also been named President of the Canadian Association of Statutory Human Rights Agencies (CASHRA), a position that gives her great influence in the ‘human rights’ industry across all of Canada.

Perhaps you remember the BCTF’s infamous “staircase” graphic, which exposed their goal of inflicting—not “tolerance”; not “acceptance”—but celebration of homosexuality and Gender Identity Disorder on public school students (One has to wonder if the top rung of the staircase will soon read “Participation”!). The illustration below was a handout at the BCTF’s February, 2010 ‘conference’ held in Abbotsford to train teachers how to implement the infamous Corren Settlement Agreement; it shows how the BCTF visualizes its role in moulding the minds of your children and grandchildren:
