NOTICE OF MOTION BEFORE THIS COURT

TAKE NOTICE THAT the Applicant/Respondent, Kari Simpson, now acting in person, hereby applies to this Honourable Court pursuant to Rule 76 of the Supreme Court of Canada Rules and/or pursuant to the inherent jurisdiction of this Honourable Court for an order granting a Re-Hearing of this matter and/or to accept and consider crucial new information and/or evidence that will assist this Court in making a just decision or such further or other order that the Court may deem appropriate.

 

            AND FURTHER TAKE NOTICE THAT the following documents will be referred to in support of said motion:

 

1.                  The Affidavit of Kari D. Simpson and exhibits thereto, sworn August 22, 2008; and

2.                  The Memorandum of Argument of the Applicant/Respondent

3.                  Such further or other material that this Court may permit.

 

AND FURTHER TAKE NOTICE that the said motion shall be made on the

following grounds:

 

  1. That my first counsel failed to comply with the Rule 19(12)(a) of the British Columbia Supreme Court, and as such fatally flawed my case from the beginning.
  2. That the trial judge failed in her duty to ensure that parties complied with the law and the requirements of the law.
  3. That my express instruction to my legal counsel was disregarded at the Hearing before the Supreme Court of Canada on December 4, 2007.
  4. That my lawyer’s failure to exercise my instructions resulted in crucial material being withheld from the court on December 4, 2007.
  5. That the Honourable Court “modified” the law and made findings based on a standard unknown to me, my counsel or the trial judge.
  6.  That this Honourable Court was made to make findings on myth and errors of fact due to my first counsel’s failure to provide particulars.
  7. That this Honourable Court has done a “substantial wrong” to the Respondent/Appellant Rafe Mair by relying on errors of fact and referring to him as a “shock jock”.   
  8. Such further grounds that this Court may permit
